MARAZUL is an independent fine art photography gallery created around a simple idea: photographs are more than decoration. They preserve places, atmospheres and moments, and allow them to find a new home.

The following information explains who we are, how purchases are made, how we process and deliver our photographic prints, and the rights that apply when purchasing from us.

Purchasing a physical photographic print does not transfer copyright or reproduction rights in the underlying photograph.

2. GENERAL TERMS AND CONDITIONS (GTC)

2.1 Scope

These General Terms and Conditions apply to contracts for the sale of photographic art prints concluded between Blaues Meer GbR, trading as MARAZUL Fine Art Photography (“MARAZUL”, “we”, “us” or “our”) and our customers.

Our artworks are primarily offered to customers in Germany and other countries of the European Union.

A consumer is any natural person who enters into a legal transaction predominantly for purposes outside their trade, business or independent professional activity.

A business customer is a natural or legal person or a partnership with legal capacity acting in the course of its commercial or independent professional activity.

2.2 Our artworks

MARAZUL offers photographic artworks as physical fine art prints in selected formats, materials and finishes.

The individual characteristics of each artwork — including the photograph, dimensions, printing material, finish and any additional specifications — are communicated to the customer before the purchase is concluded.

Every effort is made to represent our photographs faithfully online. However, colours, brightness, contrast and other visual characteristics may appear differently depending on the customer’s screen, device and display settings.

Physical prints may also show minor variations resulting from the printing process, material or format. Such minor production-related variations do not constitute a defect where they are customary and do not materially affect the agreed characteristics or artistic integrity of the work.

2.3 How a purchase is made

The artworks displayed on the MARAZUL website form part of our gallery and product presentation. Unless expressly stated otherwise, their presentation on the website does not constitute a legally binding offer.

To purchase an artwork, the customer contacts MARAZUL through the contact options provided on the website.

We then confirm the relevant details individually, including:

  • the selected photograph;

  • size and material or finish;

  • availability;

  • total price;

  • applicable shipping costs;

  • estimated production and delivery time; and

  • available payment method.

Before the contract is concluded, the customer receives the information required for the particular purchase.

A contract is concluded when MARAZUL makes a binding offer that the customer accepts, or when MARAZUL expressly confirms the customer’s order.

Individual agreements made with a customer for a particular artwork take precedence over these General Terms and Conditions.

2.4 Production

Many MARAZUL prints are produced after an order has been confirmed.

Production after receipt of an order does not by itself mean that an artwork is legally considered personalised or individually manufactured.

Where a customer requests an artwork that is genuinely produced according to individual specifications or clearly tailored to their personal requirements, we will inform the customer before the contract is concluded if this affects the statutory right of withdrawal.

2.5 Prices

The total price applicable to an order is communicated to the customer before the contract is concluded.

Prices communicated to consumers include all price components required by law, where applicable.

Shipping costs and any other additional costs are communicated separately before the customer enters into the contract.

For deliveries to destinations where additional import duties, taxes or similar public charges may apply, these may be payable separately by the customer where legally applicable.

2.6 Payment

The available payment method and payment terms are communicated before the contract is concluded.

Unless otherwise individually agreed, the agreed purchase price becomes due after conclusion of the contract and receipt of the corresponding payment information.

Where agreed before conclusion of the contract, production of the artwork may begin after full payment has been received.

2.7 Delivery

Delivery is made to the address provided by the customer.

The specific production and estimated delivery time applicable to the artwork is communicated before the contract is concluded.

2.8 Retention of title

The artwork remains our property until the agreed purchase price has been paid in full.

2.9 Statutory rights in case of defects

The statutory rights concerning defective goods apply.

If an artwork arrives damaged or has another defect, please contact us as soon as reasonably possible at info@marazul-gallery.com.

We may ask for photographs of the artwork, packaging and shipping label to help us assess transport damage and arrange an appropriate solution.

Providing such documentation helps us process the matter efficiently but does not restrict a consumer’s statutory rights.

2.10 Copyright and ownership of the artwork

Purchasing a MARAZUL photographic print transfers ownership of the physical copy to the customer.

Copyright and other intellectual property rights in the underlying photograph are not transferred unless expressly agreed otherwise.

Unless authorised by the copyright holder or permitted by law, the photograph may not be reproduced, scanned or digitised for commercial purposes, commercially exploited, modified, distributed or made publicly available.

The customer may, of course, display and enjoy the purchased physical artwork for private purposes.

2.11 Liability

We are liable without limitation for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence.

For slightly negligent breaches of essential contractual obligations, liability is governed by applicable law and, where legally permissible, limited to foreseeable damage typical for the contract.

Mandatory statutory liability provisions remain unaffected.

2.12 Applicable law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

2.13 Contract language

The language of the individual contract is agreed during communication with the customer before conclusion of the purchase.

Where the contract is concluded in German, the German version of these General Terms and Conditions shall be authoritative.

2.14 Mandatory consumer rights

Nothing in these General Terms and Conditions limits mandatory consumer rights.

If an individual provision of these Terms and Conditions is invalid or unenforceable, the applicable statutory provisions shall apply. The remaining provisions are unaffected.

3. SHIPPING & DELIVERY

Each MARAZUL print is prepared with care. For many works, production begins only after the order has been confirmed.

Production time

Our usual production time is approximately:

3–7 business days

unless a different production period is communicated for the particular artwork before purchase.

Production time refers to preparation of the artwork and does not include transportation time.

Delivery time

The estimated delivery time and available shipping method are communicated to the customer before the contract is concluded.

Delivery times may vary depending on the destination, carrier, artwork dimensions and selected material.

Delivery area

MARAZUL primarily delivers within:

  • Germany; and

  • selected countries within the European Union.

Availability of delivery to a particular country is confirmed before the purchase is concluded.

Shipping costs

Shipping costs depend on the destination and, where applicable, the size, weight and packaging requirements of the artwork.

The exact shipping cost is communicated before the customer enters into the contract.

Packaging

Our photographic works are packaged with particular care to protect them during transportation.

Depending on size and material, artworks may be shipped flat, rolled or using other suitable protective packaging.

Delivery address

Customers are responsible for providing a complete and accurate delivery address.

If a shipment cannot be delivered because the customer provided an incorrect or incomplete address, additional shipping costs actually incurred may be charged where the customer is responsible for the incorrect information.

Transport damage

If a parcel arrives visibly damaged, we recommend documenting the condition of the parcel before opening it and taking photographs of:

  • the external packaging;

  • the shipping label;

  • the internal packaging; and

  • the artwork.

These recommendations are intended to help us resolve transport issues quickly. Failure to follow them does not affect the statutory rights of consumers.

4. WITHDRAWAL POLICY

Right of withdrawal

If you are a consumer and the statutory right of withdrawal applies to your purchase, you have the right to withdraw from the contract within 14 days without giving any reason.

For the purchase of a single artwork, the withdrawal period generally begins on the day on which you, or a third party designated by you who is not the carrier, receives the goods.

To exercise your right of withdrawal, you must inform:

of your decision to withdraw from the contract by means of a clear statement, for example by email or letter.

You may use the Model Withdrawal Form provided below, but its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from the contract, we will reimburse the payments received from you, including the cost of the least expensive standard delivery method offered for the order, where required by law.

If you selected a more expensive delivery method than our least expensive standard delivery option, the additional delivery cost is not required to be reimbursed.

Reimbursement will be made without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal.

We may withhold reimbursement until we have received the goods back or until you provide evidence that you have returned them, whichever occurs first, unless we have offered to collect the goods.

Unless otherwise agreed, reimbursement will be made using the same payment method used for the original transaction and without additional charges for the reimbursement.

Returning the artwork

After exercising the right of withdrawal, you must return the artwork without undue delay and in any event no later than 14 days after informing us of your withdrawal.

You bear the direct cost of returning the goods where you were informed of this obligation before conclusion of the contract.

You are only responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning, in accordance with applicable law.

We strongly recommend packaging the artwork carefully and, where appropriate, using a traceable shipping service. This recommendation does not restrict your statutory rights.

Individually personalised artworks

The statutory right of withdrawal may not apply to goods that are not prefabricated and for whose production an individual choice or specification by the consumer is decisive, or which are clearly tailored to the consumer’s personal requirements.

The fact that a standard MARAZUL photographic print is produced only after an order is placed does not by itself mean that the right of withdrawal is excluded.

Where an artwork genuinely falls within a statutory exception to the right of withdrawal, we will inform the customer accordingly before the contract is concluded.

6. RETURNS & DAMAGED ARTWORKS

We want every MARAZUL artwork to reach its new home in the condition and quality in which it was intended to be seen.

This section explains our practical return process. It does not restrict your statutory right of withdrawal or your statutory rights regarding defective goods.

Returns under the statutory right of withdrawal

If you are exercising your statutory right of withdrawal, the conditions described in our Withdrawal Policy above apply.

Please contact us at info@marazul-gallery.com before returning an artwork so that we can provide the relevant return information.

Damaged or defective artworks

If your artwork arrives damaged or appears to have a production defect, please contact us at:

Please include, where reasonably possible:

  • your name;

  • details identifying your order;

  • a description of the problem; and

  • photographs showing the artwork and packaging.

We will assess the matter and provide the remedy required under applicable law.

Your statutory rights concerning defective goods remain unaffected.

Change-of-mind returns beyond statutory rights

Unless MARAZUL expressly offers an additional voluntary return arrangement for a particular purchase, returns based solely on a change of mind are governed by the applicable statutory right of withdrawal.

Any voluntary return right expressly granted by MARAZUL is additional to, and does not replace or restrict, statutory consumer rights.

  • information about the artwork you are interested in; and

  • other information you voluntarily provide.

Where your enquiry concerns a possible purchase, processing may be necessary in order to take steps at your request before entering into a contract.

For other enquiries, processing may be based on our legitimate interest in responding to communications addressed to our gallery.

7.5 Orders and contractual relationships

When you purchase an artwork, we process the information necessary to prepare, conclude and perform the contract.

Depending on the transaction, this may include:

  • name;

  • billing and delivery address;

  • email address;

  • selected artwork and specifications;

  • order and payment information;

  • correspondence concerning the purchase; and

  • shipping information.

We may provide necessary information to service providers involved in fulfilling the contract, such as payment providers, printing or production partners and shipping companies.

Only information necessary for the respective purpose should be shared.

7.6 Payment information

Where a third-party payment provider is used, payment-related information may be processed directly by that provider under its own data protection terms.
